I think upto Rs.3000/- no proof required. Above Rs.3000/- Rent Receipt required.

I want 2 knw dat whether Deduction of HRA can be taken in the following case:-

1) In Form 16, HRA is shown taxable.

2) In reality assessee is actually paying rent.

Can an assessee claim deduction of HRA in the above circumstances??

Yes He can.

Thank u Praveen...

Is any proof required for tht??

proof should be required but need to kept with u not required to annexed with ROI

whenever assessment takes place AO will Demand

1) Receipt/acknowlad. of the Rent Paid

2) Proof of that employer is providing same ( i. e. Salary certificate or written consent of employer)

UP TO rS. 3000/- No proof is required.

for claiming HRA the eployee should show the rent slip which is paid by the employee in month wise month........and he should proof that there have no any house for claiming HRA.

Is month wise Rent receipt is required or year end declaration by the employee is sufficient?????

no it is not mendatory to show the month wise rent declaration he can do on year wise but it depends upon the company to company..............

you should  have rent payment slips signed by the owner. if payment has been made in cash then revenue stamp should be pasted on it.

Rs 3000/- per month Or yearly 36000/- it is not cleared ? pls clear it
