Professional Tax Refund for low income

ITR 6178 views 6 replies

This question is related to a disabled employee whose total salary in a Financial Year is below Rs. 2,50,000. Does the Professional Tax Deduction made during salary release get refunded automatically to the Disabled employee account, or the Disabled employee needs to file an ITR in order to get the refund, even if the total salary is below Rs. 2,50,000 ?

Professional tax is paid at the end of month presuming that you have carried out the profession in that month. Therefore once professional tax is paid, there can be no refund. you can claim deduction of profession tax file filing your income returns.

For salaries employees PT will be deducted and paid to govt but it will not be refunded..

But  as this link below suggests https://www.indiafilings.com/learn/assam-professional-tax/, the handicapped employees will be refunded the entire PT amount deducted initially from their salaries in Assam, on filing their ITRs ?

Point noted..Is it automatic refund on filing ITR ?

Income Tax is Central Tax & PT is a state tax

Therefore once professional tax is paid, there can be no refund. There is generally no refund mechanism under professional tax. However, if the payment is made inadvertently then the professional tax act of the particular state shall mention the way to get it.

No refund of professional tax will be allowed here. Professional tax once deducted and paid by the employer on the salary is not allowed to be refunded.

However, if the employer has deducted any TDS then that can be refunded by filing of Income Tax Return.
