Pls anyone tell me answer of question 1(a) of law paper of Pcc/ipcc

Z rent out his house situated at mumbai to W for a rent of 10000 p.m. A sum of rs 5 lac, the house tax payable by Z to munciple corp. being in arrears, his house is advertised for sale by the corporation. W pays the corporation,the sum due from Z to avoid legal consequenses. As per indian contract act 1872 decide wheather W is entitled to get the reimbursement of the said amount from Z.

According to me, the answer is W is entitled to get reimbursement from Z, as paying House Tax is liability of Z, not of W.

But why here is no any contract between z and w for paying munciple tax.

As per Sec 69 of Indian Contract Act 1872, a person who is interested in payment of money which another is bound by law to pay is entitled to be reimbursed by the other person....

in this case, applying the above provision W is entitled for reimbursement ...

Dear Prateek,

The rate of TDS will be 20 per cent or rate provided in respective section which ever is higher , in all cases, if PAN is not quoted by the deductee w.e.f. 1.04.2010.
