Payment of TDS amount

I am doctor.My department did not deduct TDS from my account for last F.Y. Now they witheld my salary for February and March and asked me to make payement of TDS. Then they will release my salary.Now what I have to do ?

Hello Waseem,
First of all would like to thank you for your service during the pandemic.

Now coming to your question it is the responsibility of your employer to deduct TDS on the average income tax rate if your income exceeds the basic exemption limit as per sec. 192

You can deposit your tax while filing income tax return and your employer has no right to withhold your salary for a default/fault by your employer. You legally have no liablity to deposit TDS.

If you recieve any notice by the department you can very well reply that it was in your knowledge that it was your employers liability so you did not do the same.

If your employers continues to not deduct taxes for this FY too, you can plan your taxes for the next year accordingly
