Partnership firm and pvt ltd company having same name&owners

Hello.

It can be possible that partnership firm or a proprietorship firm has a same name. if you want to incorporate company you should mentioned such name nd owners name in incorporation form.

thanks Abhishek,but here my point is we have partnership firm now and we want to start a company with the same name in this case also no issue.

Ms shreelkshmi, if u wish to start new company, u have to apply for name in form INC-1 in which there is a point "any director has partnership firm or proprietory firm in same name or applied for same name"you must attach NOC from that partnership firm..so in ur case NOC is required to create such co. In same name..
