Pan card of owner is required for rs.1,00,000 p.a or 8,333pm

Hi All,

I have changed job last year. In between the two jobs, there is a gap of 3 months. 

My question is, is the PAN card number of Land lord is required, if the rent paid exceeds 1,00,000 in a year or 8,333 per month.

If i show proof for 8333 for 9 months of my employement it only comes to 74,997. I still have 25,003 left, so i am planning to show higher rent paid in the current company HRA of about 11,500.

Is it possible. Please advise.

it says as total 1lac rupees per year, and if you divide it by 12 it gives Rs.8333/-
it is required if the total is exceeding 1 lac, monthly need not be 8333/-
 if annual rent paid by the employee exceeds Rs 1,00,000 per annum,
it is mandatory for the employee to report PAN of the landlord to the employer
 

exemption under sec 10(13A) i.e. is not available if employee resides in his own house or does not incur any expenditure on payment of rent

for HRA purpose, actual amount of rent paid will consider

you can disclose an higher amount but you have to disclose pan number, your previous employments HRA wpuld have been disclosed and by this time you would have got F&F also, so now you can disclose whatever the amount by the time of the year if total rent. paid is more than 1 lac you have to give pan number of land lord, this is an yearly activity however as employee might not be present or he may leave company they will collect pan number if rent exceeding 8333/- per month

Total amount is countable  not monthly

Show your curent Company the Rent Adjusted in last Company,

Deduct the Adjusted Rent from Total Years Rent and show the Balance Rent in Current Company

Thanks for your reply. I have already given my company a higher rent without the owners PAN card but they have considered only Rs.8333pm. Is there a way to adjust it in the Tax returns that I should file this month? And if it doesn't match with Form 16 & Form 26AS, is that a problem.?

Thanks for your reply. I think i didn't quiet clearly inderstand the statement. Could you please explain?

will not be a problem but ask your landlords pan number ot will ask while filing, and difference if asked by income tax authorities later you have support with rent reciept.
i will explain explain clearly.

now if you want to file with higher rent you should have pan of landlord. you have to disclose and file return,

later if income tax authorities on the basis of regular assessments if they ask you then you have to show rental reciept, and difference in form 16 and 26 AS and return can exist no problem however you should have evidence why the differences has. come
Yes, You can Adjust in Your Tax Return. Your Tax Return is the Final Statement, Mention the Final Amount Total Paid in Year NO Matter what is in Form 16 & the Rent Paid is not mentioned in 26AS
