P.P.F. Deduction in Famely Members

There are 4 Members in my family. Myself, My Father, My Mother & My Father as HUF.

I have PPF A/c in one bank only. no other members have PPF a/c in any other bank.

But we together ie my father, mother, My father as HUF and myself contribute Rs.10000/- each and deposit the amount in 1 PPF a/c by issuing cheque for the same from their respective bank a/c's.

My query is : If all four family member's income is above the exemption limit, can the claim their respective amount of Rs. 10000/- as deduction U/S 80C while filing their IT return.

Note : Their is only 1 PPF A/c and Total amount deposited iS 10000 x 4 = 40000/-

                               It is not Correct. deduction of the PPF will be allowed only those person whose name account is. please write me any query related to Taxation my email id is sachinagarwalcallb @ gmail.com

U can only claim deduction of Rs 10000 only ie your own contribution. U cant claim deduction regarding contributions made by your family members. They have to claim this deduction in their own return.

Wt u can do is u can deposit the amount in the name of your spouse or children and then u can claim deduction of that also but u have to pay cheque from your account only and the maximun limlt is Rs 70000 in a year.

Since your family members would not get deduction of cheques deposited in your PPF Account. I suggest that the do investment in other avenues such as LIC, ELSS, NSC etc and take deduction over there. One Investment prinicipal is do not lay all your eggs in one basket.

Please refer Section 80C(2)(v) and 80C(4), where it is specified that any payment towards PPF a/c will be eleigible for deduction, in relation to an individual, the individual himself, wife or husband and any child.

so a deduction of Rs.10000 can be claimed in each return, i.e. you, your father, mother and father's huf.

For claiming any deduction first criteria is that the investment should be in that person name. In this particular case since PPF Account is in name of Deepen. Other Family members cannot claim deduction. I would request Rahul, Kooleo87,Sumit,Vidya & Jamin to put some more light on what I have said.

I support the views expressed by Mr. Sanjay. The assessee may claim deduction u/s 80C for deposit of PPF in his own name or spouse or children. Similarly HUF may claim deduction made in the name of any member of the HUF. However, a member can not claim his investment in the name of HUF.

Ramesh your views are the same on the PPF and the home loan improvement querry.

My assumption is that that PPF a/c is in Deepen's name. Then it is very clear. Rs. 10000 can be claimed by each of you, i.e. Rs.10000 can be claimed by Deepen himself for contribution by him, Rs.10000 by his father, mother and father's HUf each, if they all deposit in Deepens' PPF a/c. All four of them can claim Rs.10000 in their respective returns.

AS PER MY OPINION EACH OF THE FOUR ASSESSEES CAN CLAIM THE DEDUCTION U/S 80C FOR PPF DEPOSIT OF RS.10000/-.

FURTHER IF DEEPEN WANTS TO CLAIM DEDUCTION OF RS.40000/- IN HIS RETURN, IT IS ALSO POSSIBLE, IF ALL THE OTHERS CAN SHOW THE AMOUNT DEPOSITED IN PPF AS LOAN TO DEEPEN (PPF DEPOSIT ON BEHALF OF DEEPEN).
