One unit under composition, other unable to apply

A migrated dealer has opted for composition in September 2017. The application has been approved in September 2017.

As per law, two units, under single PAN, cannot be held as Normal and Composition separately. As the other unit is also required to be Opted for Compostion.

However, option for the same has been withdrawn till March 2018.

I want to know, Would it be OK to have a unit as Normal Dealer and another as Composition Dealer, and file Returns as applicable, till the option is not available?

No. All units under one PAN, in which ever state they are must be either under normal or composition.

Sir, that is what i am saying.

the dealer must now opt for Composition for the other Unit too, but the Portal has withdrawn the option of 'Opting for Composition' till March 2018.

What would be its result, as one unit is now under Composition and other Unit is as Normal and that too it cannot apply for Composition?

Sir, both the units are under same PAN in J&K,

both were registered under VAT, but with separate TINs,

both migrated 'As Normal Dealer' under GST, having Separate GSTINs

however, later on, in September 2017, one of the unit 'Opted for Composition', which was Approved in the same month.

the second unit is still operating as Normal Dealer

You mean both are separate as "Vertical Business"...???

yes, both are separate, just PAN is same

Aggregate Turnover of both, in past FY, approx 65-70 lacs
