Nri status and tax liabiity

Dear Members,

I am an IT professional and always outside India on Projects on Business Visa. (Not work permit)

Although my company pays me salary in India due to projects I am outside India for 10 months out of 12 months in FY.

My query-

1. Am I eligible for NRI status based on either Income Tax act or FERA?

2. Can I get some tax exemptions being an NRI on Indian Income?

dear PRAVIN,

1, yes u can enjoy the status of NRI

2. HOWEVER NRI are always taxable on indian income...so i think you wont be able to enjoy any benefits

Hi, I am an NRI.  Regarding the NRI status, many interpretations on various sites hence, need to ask you on this subject

The reason: After retirement, we want to visit our retirement home in India under NRI status since myself and my wife do not want to stay permanently in India.  For the past 30 years, we had been in India only for vacation say about 2-3 except once for 60 days.

The 182 days to maintain NRI status is a bit confusing not for the previous year, but further going back to previous years

Below the example of stay for 180 days,  every year,  in India to keep the NRI Status:

Between April till March during the taxation period/year  taken as example

Duration of stay:

2000-2001   180 days/ 

2001-2002  180 days/

2002-2003  180 days/

2003-2004  180 days/

2004-2005  180 days/

2005-2006  180 days/

2007-2008  180 days/

2008-2009  180 days/

2009-2010  180 days/

2010-2011  180 days

My question:  Does the above slab allow a NRI status to a person who have stayed in India every year for 180 days, i.e; from the year 2000 till 2011. Or is it differently understood
