Npa status in case of export discounted bill default

1. Credit sanction terms: Bank would deiscount only those bills whose buyers are guaranteed by ECGC via Exporters policy with ECGC and bank would also obtain Post shipment ECGC policy of its own.

 

2. Exporters covers his buyers by ECGC and bank obtains ECGC cover

 

3. One buyer defaults for 50% value of discounted bill. Exporter gives extention of due date letter to bank and also files claim with ECGC thru the bank. ECGC would take 8 / 12 months to settle / decline the exporters claim. ECGC pays claim upto 90% of default value.

 

4. RBI guidelines state that any advance guaranteed by Central govt, even if overdue, should not be classified as NPA till govt repudies the claim. ECGC is a Central Govt Undertaking and RBI circular states that guarantees given by ECGC should by treated as guarantees by a sovereign entity.

 

5. Bank has not debited the expoirters CC / Packing credit account for default value.

 

6. Exporter has several Machinery Term Loan, Packing credit and cash credit facilities.

 

Can the export bill discounting account be classifed as NPA till ECGC settles / declines the claim. Do other accounts also become NPA??   Bank wants to classfy all accounts as NPA. Please advise.

Bills Purchased/Discounted: If the bills purchased or discounted remain overdue for a
period of more than 90 days from its due date.

4.2.17 Post­-shipment Supplier's Credit

  1. In respect of post­-shipment credit extended by the banks covering export of goods to countries for which the ECGC’s cover is available, EXIM Bank has introduced a guarantee­-cum-­refinance programme whereby, in the event of default, EXIM Bank will pay the guaranteed amount to the bank within a period of 30 days from the day the bank invokes the guarantee after the exporter has filed claim with ECGC.

  2. Accordingly, to the extent payment has been received from the EXIM Bank, the advance may not be treated as a non­performing asset for asset classification and provisioning purposes.

Government guaranteed advances :

- The credit facilities backed by guarantee of the Central Government though overdue may be treated as NPA only when the Government repudiates its guarantee when invoked.

- Advances sanctioned against State Government guarantees should be classified as NPA in the normal course, if the guarantee is invoked and remains in default for more than 90 days.

Thanks for the info. Could you please check with your Boss / Seniors and inform if you would classify the accounts as NPA or not in view of the details given by me above. If yes on what grounds and also if NO then on what grounds. Please revert ASAP.
