Is there any case law for penal provision for non submission of C Forms ?

C forms are to be used by buyer for availing concessional rate of CST towards his purchases. 

if seller fails to collect and submit C forms against his sales at concessional rate, then such sales are treated as unregistered and assessed at max rate as per state vat rules, diff of tax, interest is payable by seller, including penalty if imposed.

seller has option to issue debit notes and realise the diff of  tax+interst from buyer.
