Non issuance of form 16

Dear Sir/ madam,

I have worked with Karur Vysya bank for less than a year and they are objecting to the issuance of form no . 16 to me stating that no such form is issued when the income is less than income tax limits. Here are my following questions :

  1.  Is it legal on the employers part to not issue form no 16 under such circumstances ?
  2. I worked there till october 2010 and now that i have joined another employer , how would i file my income tax for the FY 2010-2011 ?
  3. If this is illegal what is the right forum to raise my plea online/offline ?

I think, they will not issue FORM 16 bcoz neither you were with that organization till March'11 and nor you have taxable income. But they can issue you a computation of income for particular period. Ask them and request them to issue.

from 16 issued to salaried employees for knowing the details of salary and dedction of tax agianst salary.

tds will arise when we have a taxable income

so u dont have a taxable income but they didnt issued to u

may issue by ur request to them for filing the income tax return

and u file ur return according to form 16 of both of the employers

and consult the Chartered Accountant for filing the IT return after getting the form 16 from both employers.

Hi Garima...

In case your salary doesnot exceed the taxable limit, the companies doesn't issue form 16. In case your are joing any other company either you can give a declaration that your salary dosen't exceed the taxable limit or u can give ur salary slip to prove the same.

you can get in writteing on letterpad of bank that u r working there and about your salary
