Non deposit of tds

My company has deducted TDS from my salary for the f.y.2013-14. but till date neither it has deposited the TDS nor paid the salary for few months. my form 26as also doesnot reflect any TDS except for few months. The co. has not issued Form 16 also. There are some months for which I have received the salary but TDS of the said months is also not deposited.

Now if i file my ITR claiming full salary & TDS, CPC Bangalore will raise the demand for balance of Tax.

In this scenario what should I do? What is my liability & rights as far as income tax is concerned? Is there any mail id or address where I can complain to tax authorities about this?

if you have salary slip for which you have received salary and the slip mentions that tds was deducted from your salary, then on basis of those salary slips you can file your itr claiming tds deducted on your earned income.. later when i.t.dept. issues demand notice then you just have to produce those salary slips and dept. wont ques. you anymore. thereafter dept. will proceed with proper actions towards deductor.

It seems that the company is in rough shape financially. You may go ahead with filing ITR as suggested by Mr. Singh if you have the proper salary slip showing TDS deducted from your salary.

It is time to start looking for another job.
