An Assesse who is a doctor by Profession and he does not maintain books of accounts. So can he fill ITR 4 by filing the portion of No Account Case where regular books of accounts are not maintained for A.Y. 2016-17 and please tell whether there would be any problem from IT Department.

He is compulsorily required to maintain books as per section 44AA(1). So, prepare P&L acc with BS for As Yr. 2016-17.

doctor is an specified assessee under Sec 44AA to maintain books of account if he is showing business income. If no books of account is maintained then assessee may required penalty as per income tax act

Agree with Dhirajlal.
