MVAT on resale of used car

 Sir,

I am selling my used car of 4 years to MARUTI  True Value service.

I am a proprietor of my company and my CA told me to pay 12.5% VAT on sale value.

Maruti True value will also pat VAT on my cars resale from them.

So it will be double taxation. Maruti true value is not ready to accept Basic + Tax from me.

Is there any way out to avoid double taxation.

Will I have to pay 12.5% on complete amout of sale as i have already paid tax on purchase and I have not claimed it back while 

purchasing it as new car.

Is this 12.5% not wrong this forces me to sale for cheque+cash settlement.

If i am not wrong... Maruti true value will pay VAT only on margin amount... Suppose, it buys vehicle from you for Rs. 40000 & sells it to another customer for 50000. It pays VAT only on 10000 @ the applicable rate... so, i think, there is no double taxation.
