Misconduct Under CA Act

Q.1   X and Y are partners of CA Firm X & Co. Y left the firm and started practicing under proprietorship. He circulates letters to the clients of X & Co. stating that he has left X & Co. and has started practicing as Y & Co. Is Y guilty of misconduct under the CA Act ?

Q.2   A letter is sent by a CA to the Ministry of Comm. And Industry inquiring whether a panel is  being maintained by the Ministry and if so, to include his name in the panel. Is CA has acted correctly ?
