Dear Sir,

I have sold my house and earned capital gain.I have purchase new house.but for the purpose of loan in conveyance deed my spouse holds first name and my name is second.Can I claim benefit u/s.54.

Please note that I have complied with the condition of sec.54.and I also make payment from my bank account.

Is there any condition that for claiming deduction u/s.54 my name should be first?otherwise I can not claim benefit of sec.54.

There is not any condition for the purpose claiming the Exemption u/s 54. The person who earn capital gain  is only eligible for deduction u/s 54 the name whether first or second does not matter.
