Dear Sir,

I have sold my house and earned capital gain.I have purchase new house.but for the purpose of loan in conveyance deed my spouse holds first name and my name is second. Can I claim benefit u/s.54.

Please note that I have complied with the condition of sec.54.and I also make payment from my bank account.

Is there any condition that for claiming deduction u/s.54 my name should be first?otherwise I can not claim benefit of sec.54.

There is not any condition for the purpose claiming the Exemption u/s 54. The person who earn capital gain  is only eligible for deduction u/s 54 the name whether first or second does not matter.
