under section 185(2) of the Companies Act 2013 when loan is being given to a private company in this director is related then a special resolution is to be passed in the general meeting for its approval along with explanatory statements
.
Here my question is
1. When a private limited company gives loan to another private limited company in which such director is a director then whether MGT 14 is to be filed withe the roc for this special resolution or MGT 14 is not to be filed..
2. whether loans given includes advance (like any short term advance given)

Form MGT 14 was introduced in the Companies Act of 2013 with the objective of filing certain resolutions with the Registrar of Companies. Such resolutions must be filed after the passing of the same at the meeting held by the Board/Shareholders/Creditors of the company.
