The issue is whether a Non Resident can repatriate amounts boorowed from his NRE Deposits?

For Eg; An NRI is planning to avail Loan against his NRE Deposits, and the loan amount has to be credited to his NRO account only.

Now, this NRI wants to repatriate this amount lying in his NRO Account to his NRE Account.

Is there any restrictions for this?

Hi Dhanya,

Here’s a clear breakdown of your query about whether an NRI can repatriate funds borrowed against their NRE deposit, especially if those funds are moved to the NRO account:

What the RBI Regulations Permit:

  1. Loans Against NRE Deposits Are Allowed

    • RBI permits authorized banks to grant loans or overdrafts against NRE fixed deposits, provided:

      • The loan period does not exceed the remaining maturity of the deposit.

      • The loan is repaid with interest, either through:

        • Remittance from abroad, or

        • Utilization of proceeds from the NRE deposit itself, or

        • Funds in the NRO account.
This is per RBI’s Exchange Control Manual provisions Reserve Bank of India+1.

  2. Non-Repatriability of Loan Proceeds

    • The funds borrowed against NRE deposits are restricted to non-repatriation usage—they cannot be transferred outside India. Specifically:

“Investment made out of the loan shall not be allowed to be repatriated.” Reserve Bank of India

What This Means in Practice:

  • If you borrow from your NRE deposit and route the funds into your NRO account, you cannot then repatriate that loan amount to the NRE or overseas.

  • Even after linking Aadhaar or making the PAN operative, this restriction remains—the loan proceeds must stay in India and be used accordingly.

Real-Life Threads Reflecting This:

  • Users confirmed that loans in India cannot be freely repatriated, and doing so requires strong justification and documentation Reddit.

  • Banks often require Form 15CA and 15CB or a CA declaration even for remittance of personal funds from NRO to NRE/NRE to abroad (some banks exceed RBI guidelines) Reddit+1.

Summary Table:

Action Permissible?
Borrowing against NRE deposit Yes, within RBI guidelines
Routing loan proceeds into NRO Yes
Repatriating loan amount (to NRE/abroad) No — not permitted
Transferring NRO income (interest rent etc.) up to USD 1M Yes (subject to documentation)
