Kindly provide me some suggestion. In case of employee is in probation period and he has been grated Eearned as per the companies policies. He has resigned before the comletion of Probation period. Now he want us to reduce the notice period with the Earned leaves granted to him/her.

Now question is

Is it mandatory  as per the any law?

Any  legal hassel that he can create?

It is not mandatory as per any Law.

 

He can not challenge this legally.

 

Some companies follow this practice and they adjust pending leave balance with notice period. But this is done as per Employers choice and they are not liable to follow this practice.

 

Also it should not be done from taxation point of view as this would reduce taxable income of an employee.
