Late filing of itr 4

Dear Experts

My client working for a Telecom company and he has not filed his ITR for the AY 2009-10.  But his company deducted TDS now he wants to file his ITR.  TDS deducted from the Comapny above Rs.6,000/-.  Now my query is can we file by E-filing the ITR now by deducting penalty from deducted TDS.  If Yes How? Please reply.........
