Itrv received after due date

I filled my father's Income Tax return for the FY-13-14 on last day i.e 31-07-14, however I was supposed to send the ITV copy to CPC within 120 days ie. by 30-11-14, I sent on 1-12-14 and it was received by IT department on 3-12-14. 

Now In Income Tax department efilling website status of efilling is showing as "ITRV received after Due Date" then what is the recourse for me?

I read somewhere that I can file a revise return also I have heard that if ITRV not send to CPC within 120 days the return filled stands invalid, I am confused, please assist.

Although the status is shown as received but as you know the return does not has legal effect in such cases. It is just a prima facie evidence of your income and taxes thereon , that is , just having something than nothing. These details in rare cases are used by the department, lets not get into it.

 

What should be done?

"If the Original e-Filed Income Tax Return is invalid because of non-receipt of ITR-V, can I file Original return once again?

Answer: If 120 days period (with extension, if any) has lapsed then assessee is required to file a Revised return, however, the revised return filed now will be treated as Original return.      "

Thank you. So now further question arise in my mind:

1. Do I have to file new return with penalty?

2. While filing this revise return do I have to provide the last acknowledgement no.?

3. Do I need to send the prior return ITRV along with new ITRV copy to CPC Bangalore?

2 when you will file the return then select option of revised return, (139(5)) , then it will ask for acknowlegement no. , use that acknowledgment no u received on filing the return

3 Only send new one

And what if original return was filed u/s139(4)???

What happen if i have claimed for Refund, and ITR received by department after due date? Will my refund will be rejected??

 

or what kind of steps to be taken to get my refund from Department.??

You will still get your refund no issues.

You may file Grivieance if there is inordinate delay in grant of refund. Alternatively you may also file a refund application to you A.O. But, these steps should be taken if there is inordinate delay in grant of refund.

Sir/Madam,

I have received one of my clients intimation stating that his ITR-V has been rejected for the A.Y.201-2012 as it was filed after due date and was received at CPC after 120 days after filing. It has been suggested to do revised return u/s 139(5). But the date for so is also expired. So what further action shall be taken for rectification. Please do help.
