To properly report your share market transactions in ITR-3, you must distinguish between your trading activities, as they are taxed under different heads of income.

1. Intraday Trading

Intraday trading is classified as Speculative Business Income under Section 43(5) of the Income Tax Act.

  • Income Head: Profits and Gains from Business or Profession (PGBP).

  • Reporting: It must be reported under the "Speculative Business" section in your ITR.

  • Key Points:

    • Losses: Speculative losses can only be set off against speculative business gains. If you have a net speculative loss, it can be carried forward for up to 4 assessment years (provided the return is filed before the due date).

    • Turnover: For intraday trading, turnover is calculated as the sum of the absolute differences (both profits and losses) of all trades.

2. Delivery-Based Trading

Delivery-based transactions involve taking ownership of the shares in your Demat account.

  • Income Head: This is typically treated as Capital Gains (Short-Term Capital Gains if held for ≤ 12 months, Long-Term Capital Gains if held for > 12 months).

  • Consistency: While you generally treat delivery-based trades as capital assets, you may choose to treat them as "Stock-in-Trade" (Business Income). However, the CBDT mandates that you must maintain consistency in your method of accounting from year to year.

  • Reporting:

    • If reported as Capital Gains, use the "Schedule CG" in ITR-3.

    • If reported as Business Income (non-speculative), it is reported under the "Business/Profession" section of ITR-3.

Summary of Differences

Feature Intraday Trading Delivery-Based Trading
Classification Speculative Business Capital Asset (or Non-speculative Business)
Income Head Business Income Capital Gains (or Business Income)
Set-off of Losses Only against Speculative Gains STCG/LTCG can be set off against other Capital Gains
ITR Form ITR-3 ITR-3

Important Filing Tips

  • ITR-3: This is the correct form for individuals with business income from share trading.

  • Audit Applicability: A tax audit may become mandatory if your turnover exceeds specified limits (e.g., ₹10 crore if 95% of transactions are digital) or if you declare profits lower than the presumptive thresholds while your total income exceeds the basic exemption limit.

  • Supporting Docs: Always keep your contract notes, P&L statements, and Demat transaction reports handy to substantiate your claims.
