If TDS is deducted u/s. 194H or 194D, it will be treated as business income, and hence ITR3 mandatory.

Yes, you have to file ITR 3. All the above comments are right in there own ways. To summarize the same, it can be said that, income from commission is treated as Income from PGBP but not covered u/s 44AB or 44AE. Hence its return cannot be filed through ITR-4 and hence ITR-3 needs to be filed.
