Dear Sir,

I want to know that, now the day i want to efile the ITR of indivudial for the A.Y. 10-11, 11-12 and 12-13 for the purose of TDS refund. So, Please tell me what is the penalty in that case and i can file the return or not, and person who has below of exemption limit it means Nil return amount.

For A.Y.2010-11 You cann't file now as well as refund of Such TDS not gives you because of due date to file return of income according to section 139(4) as belated return also elapsed. I.e For A.Y. 2010-11 Return of income could be file with in 31-3-2012 only. So no chance to file now.

However for A.Y.11-12 and A.Y.12-13 return of income you can file now because of due date according to the section 139(4) for such A.Y is 31-3-2013 & 31-3-2014 respectively.

However no penaly will be levay in that cases because of you are saying the taxable income is below the examption limit as well as For your income Tax has been already deducted so you didn't escape the tax amount libility if any so Penaly will not immpose on such cases.
