Hi CCI members, wish you all a great day.

Can anybody help me please,

ITR for AY 2011-12 was filed on 30th july 2013 and assessee was entitled to refund for AY 2011-12. But refund was not yet issued, IT Department is saying that return was after due date so return is void no refund shall be issued. And asseessee is a female senior citizen

In this case is assessee eligible for refund for AY 2011-12 ?

If eligible, what shall assessee do to get refund ?

Itr is actually filed beyond the time limit and it's time barred. Belated return can be filed only up to 31.03.2013 in case of ereturn for ay 2011-12. Assessee being a female senior citizen would not help in any way.

All you can do is requestby an application for condonation of delay stating reason for delay. Give appropriate reason for delay as it might get rejected. Address the same to CBDT only if the claim amount is beyond 50 lacs or 50 lacs. In case the amount of claim is between Rs. 10 lac and 50 lac the application will have to be made to the Chief Commissioner of income tax or Principal Chief Commissioner of Income tax. However, in case the amount involved is less than 10 lacs, the same can be entertained by either Principal Commissioner of income tax or commissioner of Income Tax.
