Quick Summary
This discussion addresses whether an individual can re-opt for presumptive taxation under ITR 44AD for AY 2021-22, having missed filing for AY 2020-21. The consensus is that if the previous non-filing or non-selection of 44AD was due to turnover exceeding limits or income falling within the basic exemption limit, then opting back in for AY 2021-22 is generally permissible. It's also noted that the restriction under sub-section (4) primarily applies when an eligible assessee fails to declare profits in subsequent years.

It depends on the reason why it was not opted during ay20-21 or rather why no return was filed. If it was not opted because the turnover was more than the limit or if the income is within the basic exemption limit, then yes, you can opt for it again, I think.

As per my understanding, sub-section (4) is applicable only when the assessee does not declare profit in subsequent years as per sub-section (1) despite being an eligible assessee.

Is it like this?

Yes you can file
