My uncle will file has AY08-09 return in few days. It turns out that he has tax to be paid for that year.
Few questions:
1. Along with tax, is there any penalty to be paid for late payment of tax?
2. Can he file his AY08-09 return thru E-filing? Or does he have to file at his local Income tax department?
Please let me know.
E Filing portal would not allow your to file return for AY 2008-2009 as you are going to file the return beyond the period stuipulated for belated return. It will throuw you a masssage as "to contact to Income Tax Department for clarification". Even for the physical filing of E return for AY 2008-09, Income Tax department would not accept return.

What I understand from your question is this.
PY 2007-08 (AY 2008-09) return of Income will be filed.
You will be making a great mistake.
Deemed concealment gets applicable. Explanation 3 to S 271(1)(c). Then S 147 shall follow.
