is registration u/indian registration act mandatory?

dear all


i have one doubt regarding the requirement of registration under indian registration act for the matter falling u/s 394 of the CA1956.


when there is reconstruction or amalgamation u/s394 of the CA1956, when the court gives order approving the reconstruction or amalgamation, then it is said that by virtue of such order, all the property and liabilities of the Transferor company will be transferred to the Transferee company.

lets say that includes the property and or liability for which registration u/s 17 of the indian registration act is mandatory, then do we need to register such court order with registrar concerned, or do we need to enter a separate agreement of appropriate value in lines of such court order and register the same with the registrar?

my question involves two parts:

is registration of that required or not?

if registration is required then registering of that court order or a seperate agreement on the lines of court order?

Dear sameera,

 

Registration is not required, instead transfree company need to intimate officially to all concerned departments along with the copy of order of the Court.
