if a registered person purchases goods worth 10000 (5% gst) and sells as a finished product ( comes into 18 % slab)

how can he avail ITC?.

according to SECTIONS referring to ITC restricts claim of different rate.

There is no such restrictions in the Act. You fan file the return GSTR 2 (which is auto populated from GSTR 2A) and also can add/ modify such return accordingly and avail ITC on provisional basis
therefore, there is no such restrictions for claiming ITC

only in case of refund, if any, there is a restriction u/s 54(3)(II). ??
