Input service tax rules

Dear sirs,

              We pay service tax on rent payable on building in which we are manufacturing non taxable goods.The building owned by us is leased out . We pay service tax on rent received. Can we avail input tax paid on rent paid to set off the service tax payable on rent receivable.

No rent paid on building which is not utlised for providing taxable services cannit be set off agains5 rentvrealised on some other building

Cenvat credit can only be claimed against the manufacture of taxable goods. Since, you are manufacturing non-taxable goods, you cannot claim Cenvat credit.
