Individual working for a firm to take sales orders on fixed commission basis

My friend is working as a sales representative for a firm. He is not an employee to that firm. He has a small set-up with 2-3 employees. Business not registered with the local body.

He gets a commission on the turnover generated through him.  Approximately 36 Lakhs commission he is getting in a financial year. 

Please advise on the following:

  1. Can we declare this commission under presumptive taxation?  
  2. If yes,  which category -  Business or profession 

     3. Advise about the GST implications. Whether he has totake GST registration and file GST return monthly?

    4. Whether he has to take local body registration for this

  2.  File commission income under normal assessment.
  3. GST registration mandatory.
  4.  Yes.
