India singapore dtaa

Hi,

I worked in India during the period Apr - Dec 16 and in Singapore from Jan 17 till now. As per India Singapore DTAA Article 4, I tie break in favor of Singapore as a resident for Singapore FY 17 (Jan - Dec'17). As such, I will be paying taxes on my salary in Singapore for FY17.

1. Do I also need to pay taxes in India for the period Jan-Mar'17?

2. Which form to file for the tax return?

3. Will the Jan-Mar'17 salary earned in Singapore be exempted from India tax under the DTAA.

Highly appreciate the clarification here.

Regards

You are a resident of India unless you are RNOR. In case of former you have to show income of Singapore and then take credit of tax paid in Singapore. Form ITR2 should be good if you don't have any income from Business and Profession. you need to pay some tax in India only if Indian payable tax would be more than that payable in Singapore
