Dear Professional Coleagues,

If Foreign National or NRI come down to India and proposes to incorporate company, still MOA, AOA and other incorporation related documents needs to be notarised/appostilised outside India or not required.

Dear Friends,

I could find answer to my query as per Rule 13 of The Companies (Incorporation) Rules, 2014, where subscriber to the memorandum is a foreign national residing outside india and visited India and intended to incorporate company, in such case the incorporation shall be allowed if, he/she  is having a valid business Visa.

In case of person is of Indian origin or overseas citizen of India, requirement of business visa shall not be applicable.
