Income Tax TDS Rectification

TDS 256 views 6 replies

For A.Y. 2018-2019 total TDS deducted is 169937.00. This is as per Form 26 AS. Income tax department has made a demand of 90000 claiming tax deducted is much less. I applied for rectification on the income tax portal. However my rectification request has been rejected. I have re-submitted the request. What can I do if my rectification request is rejected a second time.

You have to pay such tax demand otherwise extra penalty will be imposed if delay... 90000 demand imposed because tds have less deducted by deductor
Check out the reason for rejection of rectification. May be some entry will be misleading.

Match TDS as per Portal and as per IT return and then again apply for rectification. Also check out that same amount of TDS reflected in Form 26AS also.
Ask for TDS statement for that period and check with TDS in 26as and see Where's the mismatch
and check the intimation letter where's your and their calculation goes wrong
and check why your rectification rejected
then apply for rectification once again
I think you should go to a chartered accountant and consult there.
The demand might be due to 2 reasons
1. there's a mismatch in TDS amount as per your claim in ITR and the credit given by cpc while processing. if so file rectification application enclosing the form 26as
2. the actual tax liability was rs. 259937 where's the TDS deducted was only 169937. if it's so then pay the demand but before paying the demand please verify whether the due consideration has been given in respect of the deductions claimed by you in your roi
The demand applies for two reasons:
1. there is an error while filing itr .It may be arithmetical or error due to any reasons whatsoever.
2. or income short reporting.

Notice can come in two ways
1. Sec 143(1) or Sec 154 or other sections.
Now an assesse has to download the demand notice and study the annexure attached , how they hv computed.
Any difference has to be studied very minutely and then we can reach to a consensus.
