Dear Payal,

yes, the return will be treated as a defective return. since self assessment tax is to be paid before filing of the return.

Hello Payal

ankit is right.... Return will be treated as defective return....!!!

It would be counted as a defective return

Infact, only physical return can be submitted without paying tax... For efiling of Income Tax Return, it is mandatory that all tax is paid before submitting the return

Dear Payal,

You can pay the taxes now with interest.

From recent budget, return will be treated as defective if tax and even interest for deferment of advance tax or for late filing are not paid at time of filing of return. If you have received a notice of defect, calculate tax and interest properly and file the return in compliance with the notice. If you have not received notice of defect and wish to play safe, calculate all taxes and penalty for late filing till today, and interest etc. and pay self assessment tax and file a revised return claiming the tax credit of the recently paid challan. However do the latter ONLY IF you have not received a notice of defective return or you have not received any intimation u/s 143(1) raising a demand AND your original return was filed before the due date of filing of return. If you have received intimation with demand, please pay the challan as tax on regular assessment accounting head 400 within the time limit and you can send copy of the challan to your assessing officer and the CPC so that record is clear at both places. If your original return was not filed in time do not pay any self assessment tax now but wait for a demand to pay or pay self assessment tax only when you receive notice of defect.
