Dear CA team, 

I have received a income tax penalty for the AY 2013-2014 for a small amount, due to mismatch of rent receipts. I had paid my rent in Bank account transfer, but for 3 months i had given in cash as requested by landlord. I was staying in the house for 4 years i didnt bother to keep detailed records for every month. I got a IT notice for showing me all the proofs, i was able to show all proofs except for those 3 months rent. Hence the IT dept imposed a pennalty under sec 271 (1) (C). 

I would like to know how cani pay the amount online ? 

On the epayment site i am chosing Challan no ITNO 280. What should i chose under Type of Tax: Should i chose Tax on regular Assessment ? 

Can somebody guide me on this.

Yes and when you reach bank site enter in the column penalty.

Hi,

select the tax on regular assessment.

Genuine reason can be allowed by explaining why to pay penalty apply to commissioner under section 264 and get relief

'If appeal time is unexpired,   file an appeal before your juristictional CIT (appeals) with suitable ground stating that it is unintentional,   and try to explian him ,  only documentary proof for a part of the year is unavailable but the amt. is genunine and that too for remaining months the same was produced before AO.  You got a fair chance to win over the case...

Thanks all for the response. The AO officer was from Mumbai and I moved to Bangalore. It was difficult to convince the AO officer  on phone and i wrote 2/3 long letters explainng the reasons but he didnt accept it. Also i didnt get a good CA or tax expert to represent me infront of the AO. Making trips to Mumbai to go argue was becoming expensive. Will try talking to the AO again and file an appeal.

You may request PCIT/CIT of Mumbai to transfer your file to Bgl. They have to transfer as you have no place of Interest at Mumbai as of now. Try it and once file is transfer ti Bgl you may in person appear before new AO. Good luck Ganeshan N
