I want to confirm what is the income tax liability of a religious trust which was formed as a trust before Income Tax Act, 1961. Whether this trust has to be registered under section 12A compulsorily to take advantage of tax exemption?

Yes. if you want to take advantage of tax exemption then Trust must be registered u/s 12 A

it has to file return compulsory under section 139 (4A)

it is bettr to get registered under 12A and also u should consider proving all your donations for 80G as well..

Thanks for the reply.

I would also want to know  that whether following steps are right to make registration of any trust

1. Register the charitable or religious trust according to State Govt law

2. Then again register the trust as per 12A section for Income Tax exemption at Income Tax Dept

3. Then for obtaining 80G Certificate, one has to proceed for 80G Certificate

4. Then one has to proceed for FCRA Certificate for a Trust

Kindly confirm the sequence of procedure to be followed.

Thanks
