What are the consquences if the income tax return was to required to be filed online and  the same
was filed manually??

Are there any outcomes of penalties that might be charged? 

any expert to help me out with relevant provisions of the Income Tax Act?

If it is related with last 2 financial year, just file it online right now again , because your existing paper return already become invalid. Penality can be levy u/s 271 F (Rs 5000) only in case where return not filled before the end of the assessment year 139(1).But probability of levi penality is very less.

Dear shikar, My question is, what if I'm abiding mandatory provision of filling return online and filling it in paper form? Are there any provisions that empower department to charge penalty as the same was filed manually

In any of the following cases the Income Tax Department has made it mandatory to e-file your Return (Fy 2014-2015)

  • you have to claim a refund
  • Your gross total income is more than Rs 5,00,000
  • You want to claim an income tax refund. Those who are over 80 years old and are filing ITR-1 or ITR-2 can still file a paper return to claim a refund.
  • ITR-3, 4, 5, 6, 7 have to be mandatorily e-filed.

There is no specific provision for penality in such case, but penality u/s 271 (f) (Rs 5000) exists.

Thanks shikar I just wanted to make sure that there are no provisions in the act, for penalizing the assessee Thank you, your reply will help me to handle matter more confidently..

Check the status of the return. It may result into defective return, but if the AO approves the itr then no issues. Else you need to apply for condonation of delay and file the itr to avoid any more further penalties. Penalties also depend upon AO. He may or may not levy

The return resulted into huge demand, as I'm not in possession of 143 1, though there were not any chances of demand as the tax liability was already met.. Also return was filed in time.. The assessee made mistake by choosing to file manual where he was liable to file through online Will there be any penalty for the above ? My doubt is was the above mistake that caused demand as per other provisions? As he has contravened the mode of filling has this empowered ao to raise the demand?

Please elaborate your question with figures and complete facts. Normally they do not raise demand sheer because of that reason.

Please request for intimation u/s 143(1). You will get to know the income as per return and income as computed u/s 143(1)
