Dear All,

My relative was in India during FY 15-16 till 29th Aug 2015. Till 29th Aug 15 he was in continuos service in India. Then he joined job in Dubai. After getting cash salary for one year, he was continuosly remmiting it to India to his family.

Please help in below queries:-

1. Could you please assist me in knowing his residential status?

2. In which FY he will be treated as NRI?

3. As Dubai is Tax free country, whether he needs to pay Tax in India? If yes, than till which year he will be liable to pay tax in India on salary income earned in Dubai.

In fy 15-16 he has left on august ie before 29th of september so in that financial year he will be a non resident since he has left abroad for a job

salary income if remitted to india is not taxable in india

1) & 2) Non resident for FY 2015-16

3) He is liable to tax in India for income genereted till 29th August 2015 in India. For income accrued and received outside India from Dubai job, He is not liable to tax in India on account of his non resident status.

Thanku so much both for your valuable feedback. I am little bit confused on 2nd condition which says:-if you are in India for 60 days or more during the year and 365 days or more during the earlier four fiscals. its i think not applicable as hes outside india for employment purpose. pls confirm.
