Income earned in Oman Taxable in India????

Tax queries 2463 views 3 replies

hello friends.....

I had a tax query and thought would be the best site to get the answer.

I need to file tax return for the yr 2009-10, the last 3 months of which (Jan-Mar 2010) I was in Muscat, Oman counrty (Outside India). So jus wanted to make sure regarding the taxability of my earnings in Muscat before filing my returns in India. Here is his query:

- I'm working here in Muscat, Oman on 2 years employment contract, salary is also received in local currency. For purposes of calculating my income tax liability for the year 2009-10, would my income earned in Oman (for Jan-Feb-March 2010 for the yr ending 31/3/2010) be liable to tax in India?

How to show this 3 months income in Indian tax return??

What does the Tax treaty between India and Oman specify regarding this??

I would appreciate anyone could help clarify on the above.

As u r resident in india...............stay is more than 182 days.....yes income tax is levied......as for resident,,global income is taxable.....i dnt knw wheather there is any treaty btwn OMAN & india..bt if it is..then dtaa provisions will apply to u....also u will get tax rebate.......

Agree with Mr. Maulik

Thanks for the quick reply....

but correct me if i'm wrong : as per the definition for determining residential status any person going outside india for purpose of employment is considered to be non resident from the day he left India.

so if i follow the definition then i'll be NR.
