At least some cheers for CA students. Amarjit Chopra, ICAI president has announced that from May2011 onwards; students will be allowed to see their answer sheets.

 

He also announced that within one year, girls will outshine boys ( i can't understand what this actually means) and has confirmed the establishment of "Students Benevolent Fund".

That is a good news  for the students. It help them to evaluate their answers and know their shortcoming and topics requiring more focus. Welcome move by ICAI..........

ya it is, gr8., my final attempt is in may-11 only, so i think i can evaluate & judge my self.

Its really very good move. But its actually impleted??? Because who know Chopra sir still here as president upto may11.

In may 2011 our chopa sir will  not be our president....new president then may change this fully coz  IN MY OPINION THIS  IS VERY DIFFICULT coz alloting anwers papers will create more controvery..waise junta i never believed ICAI deliberately FAILS students coz rank holder in ca pe 2 can never fail in ca final.....aloocatiing papers is possible only when ICAI can declare 100% result which is not MARKET SUSTAINALE..ICAI needs change BIG CHANGE take only AFEW STUDENTS in CPT n pass them upto final without fail........so i mean CAT like exan taking quality n in definite time u become CA....only allocating answer paers WILL NOT HELP..if it all happens..

Friends this is nothing New information, but what  ICAI have done under court orders for RTI CA Amarjitsir has just officially announced. Iknow one girl from Mumbai & also that case have come in Times Of India, she applied under RTI for papers, ICAI refused & shae filed a case with Bombay HIgh court & Court ordered ICAI to give paper copies & also said that Demanding of answer sheets of ICAI also fall under perview of RTI, same judgement given by Delhi High courts & RTI Commission at Delhi,The court rulings are of 2009 any one wants to confirm check on Google search under I RTI of ICAI Answer sheets. however I have attached both case judgements, so Mr CA Chopra has just made an announcements officially avoiding th hassles & embarrasments being fced by ICAI due to loosing cases under ICAI, which ICAI tried a lot to keep themselves out of RTI but could nat manage it, SO even today if you want your answer sheets you can apply for it under RTI & along with your appication send copies of this judgements & you will get it within 30 days as per RTI act provisions. Do it application cost only 10/- & photocopy cost of answer sheets & again ICAIhs to give within 30 days so this route is cheaper & sure to get within 30 days, as under revaluation it is at discretion of ICAI as to time when they declare results & als 100/- per paper so go ahead & all students afte this results flood your applications under RTI for copy of answershets

Facts:

1. The appellant was heard on 13/7/2009 through a representative.

2. The appellant has asked for a copy of the evaluated answer sheets in respect of a final examination, in which she appeared.

3. The CPIO and the Appellate Authority have replied but refused to provide the requested information, without indicating the provisions of the RTI Act under which exemption from disclosure of answer sheets has been claimed by the respondent.

4. During the hearing, the appellant cited a few decisions of this Commission, whereby the disclosure of evaluated answer sheets has been allowed. He also presented a news report, which confirmed that a Commission’s decision challenged by the respondent before the High Court of Delhi in an identical case of disclosure of answer sheets has been upheld.

Decision:

5. The appellant has asked for a copy of her own evaluated answer sheet. The CPIO and the Appellate Authority have not indicated the provisions under which they have claimed exemption from disclosure of the information. An examinee has the right to access the evaluated answer sheets so as to make self assessment of her performance. In view of this, there is no justification for denial of the requested information. The CPIO is, therefore, directed to furnish the requested information within 15 working days from the date of issue of this decision, failing which penalty u/s 20(1) of the Act would be imposed.

6. The appeal is thus disposed of.
