Hra is '0' in form 16 but i paid rent, can i claim refund?

Hi experts,

I missed submitting HRA on company tool in the begining of the year (april 12). Later company told that they did not consider me for HRA as i didnt submit it on tool and they have deducted tax.

My Form 16 shows HRA as 0 as below:

House Rent Allowance = 0 Rs

I have paid rent and have all the receipts for the year. I want to know if its possible to claim a refund basing my rent receipts?

in your case you can not claim refund of rent paid

You can get directly deduction u/s 80GG of Income Tax Act,1961 subject to maximum deduction Rs. 2000/- per month.

Mr.Kailash,

You can file your tax returns by re-calcualting your HRA Deductions eventhough company has not considered your rent expenses and claim refund of TDS .

As the other friend said, you can claim through Sec.80GG also.

But Ist one is benificial for you

Hope you have seen other two replies below. Now this is where i am getting confused. as below, another person in my org suggested sec 80GG .

can you please explain a bit as to what is the reason i will not get any refund?

PLease re caclulate the computation by claiming the HRA and file the tax return.

YOu cannot claim rent u/s 80GG as it is deductable only in case if the person is self employed and its not applicable to salaried people.

80 GG is applicable to every one except an employee who receives HRA from employer. ie., If your pay slip has a componenet of HRA, then you cannot avail 80 GG.

Assuming that you are receiving HRA as part of salary, but HRA exemption is not in form 16, You can calculate your HRA exemption and place it in the place of "0" in your form 16, calculate your refund. Fill your ITR accordingly.

But, If you are not receiving HRA as part of salary, then you can avail 80 GG.

I advise you to take help of a tax consultant, they may charge hardly 200/- or max 500/-. If you do on your own, there may be a mistake while calculating refund. Also keep your calculation statement in your tax file, for future reference.
