How to nullify outstanding tax demand

Hi,

I received acknowledgement on the ITR filed for 2014-15 and i observed that :

Total Oustanding demand payable (8-9-10) (excluding interest u/s 220(2)) : 640

I also observed outstanding tax demand for assessment year 2012-13 of 620 INR in my account online under "My Account" tab.

So i initially paid 620 and after a week I paid 30 rs, in total i paid 650. 

Now i want to inform incometax dept that this should be nullified as I've made payment already.

How should i do so ?

Should i 

1. Send a courier to CPC bangalore with both the chalan number printouts alongwith ITR of 2014-15 ?

2. Is it possible to do so online ?

Please let me know.

1. Yes you will have to send the challan print out alongwith the ITR of 2014-15 to the CPC attached to a letter explaingin that you have paid the outstanding tax demand. Preferably alos include a copy of the letter you received from the IT departeemnt outlining the 'outstanding tax demand'.

2. No you can not do this online. Snail mail is the only way.

 

Send a copy of challan to bangalore

ICAI should take up such issues with CBDT for online reporting to CPC, Bangalore.

Online status for my Outstanding Tax Demand has been changd to "Demand Determined By AO" and Rectification Right is "CPC"

 

What does this mean ?

it means outstanding demand has been confirmed and rectifucation is under process....This is not a serious issue u can also file online rectification order

Hi Aditya, Thanks for your response but still am confused. Sorry I am not acquainted with such terminologies :-)

Actually status change "Demand Determined by AO" changed on the day I met the local AO and gave him challan # of tax payment for the outstanding tax demand and he stamped on that request to nullify my outstanding tax demand.

Now does this mean that issue stands resolved or I still need to do rectification request ?

IF yes, where can i get the latest communication reference number from, which is required for submitting online rectification request ?

Hi,

Finally I got my demand nullified after waiting for more than a month after payment done against outstanding payment demand.

I would like to share here how we can do so :

1.  Please follow steps mentioend @  https://www.youtube.com/watch?v=ltlqqGnrGZA to make the payment.

2. After making the payment , we need to request respective IT body to nullify it. This can be done in two ways :

a. If you have filed ITR manually for the AY for which demand is being made, please visit your local income tax officer requesting him to nullify your demand alongwith challan # of the payment done, ITR for AY and request letter.

b. If you have filed ITR online for the AY for which the demand is being made, please send all above mentioned documents to CPC bangalore.

3. After doing step # 2, I waited for more than a month and now I see there is no demand in my account.(How to view it ? )

Here's how :

1. Login to your account @  https://incometaxindiaefiling.gov.in/e-Filing/UserLogin/LoginHome.H T M L

2. As soon as you login, a page will welcome you with the link "My Pending Actions". Click on it.

3.You should see the status if there is a demand. You should see nothing if the demand is nullified.

How can i respond to outstanding tax demand uploaded by CPC bengaluru u/s 220(2), for the A.Y. 2005-06 , eventhough the assesse discharged all his tax liability at the time of filing ITR for the A.Y. 2005-06.

Dear Tarun Chaturvedi,

In oneof my assessee case same thing is happned.

even if he discharge from liability first see intimation u/s 143(1) and 154 for is there any demand.

this 220(2) interest demand means you have demand in assessment year 2005-06 which was adjusted against refund for upcoming assessment year or the assessee has paid the demand.

if you disagree with demand and assessee has not paid the demand raised in assessment year 2005-06:-

then you have to right this to Assessing Officer only becoz the return for AY 2005-06 was submitted manually and in this case CPC will do nothing.

in this case you have to write to AO for nullify the demand for Assesment Year 2005-06 and also ask for refund which was adjusted against demand in AY 2005-06.

for quick action you can first write to AO along with CC to Addtional/Joint Commissioner on Income Tax and wait for 30days if no action is takenup by them.

then stright a way right to income tax ombudsman so they have to take action within 30days.

if you agree with the demand and assessee has paid the demand:-

then you have to pay 220(2) demand as well with 400 challan code and 20 in case company or in other case 21

then write to CPC Bangalore alongwith Challan copy they will remove your demand.
