How to claim TDS in this situation?

I worked with a person who received the money for our work (I don't know if he received this money in his personal account or as a business entity). He received 1,20,000/- in total.

We were to receive half each. He instead deducted 40k tax out of these 120k, and then divided 80k in two parts and gave me 40k.

I think even if he received money in his personal account as an individual entity, he could have given me 60k and then let me handle the taxes on it. But he refuses to even talk about it now.
What makes more sense? giving me 60k? I have his PAN number, can I claim some sort of TDS on it?

Pls clarify contractual work
First of all there is no 33 percent tds rate.

2. ask the person who paid you if he deducted any tax.

3. people change once they receive money. so can't do anything.

4. better move on and find a better business partner.

5. you can't claim any tds. only resort is to ask the tds deductor how much he deducted and for whom. if he is helpful you can do something.
