Firstly, Bank will sanction the loan to owner of the house. If husband is not owner of the house, then Bank will finance to wife only. Hence all the loan documents will be on the name of wife. In this condition, husband will not be able to availe the benefit of housing repayment/interest.
If the loan is on the name of husband and wife but the house is registered on the name of wife, then if the repayment of housing loan is paid from the savings account of husband, only then he will avail the benefit of housing repayment u/s 80-C or interest on housing loan.
