Reg : Budget 2009 - Scope of Gift widened with inclusion of Immovable property bought at lower than stamp duty value

My relative bought a flat and got possesson in Sept 2009.All the money has been paid in Sept 2009. The above provision is said to apply from 1st Oct 2009. Will he come under above rule? For information Registration has not been done.
