Hi experts need some help

**Query regarding ITR for Affiliate Income**

Hello,

I earn affiliate income from **NordVPN** and **Amazon Associates** by referring customers through affiliate links.

Since **commission/brokerage and agency business are excluded from Section 44AD presumptive taxation**, I am confused about the correct ITR form.

1. Should I file **ITR-3** for NordVPN affiliate commission?

2. Should I file **ITR-3** for Amazon Associates affiliate commission as well?

3. If the company describes the payment as **affiliate commission/referral or marketing income**, does that change the applicable ITR form?

I would appreciate guidance on the correct ITR form and tax treatment for both types of affil

iate income.

Quick Summary
This discussion clarifies the correct Income Tax Return (ITR) form for individuals earning affiliate income from sources like NordVPN and Amazon Associates. Due to commission and brokerage businesses being excluded from presumptive taxation under Section 44AD, ITR-3 is generally the mandatory form. This allows for the deduction of relevant business expenses, leading to a more accurate calculation of taxable profit. The specific label used for the payment, such as 'referral' or 'marketing income', does not alter the requirement to file ITR-3.

  • Form to File: ITR-3 is mandatory for both NordVPN and Amazon Associates income because commission/brokerage businesses are explicitly excluded from Section 44AD presumptive taxation under Section 44AD(6).

  • Payment Labels: Describing the payout as "referral fees" or "marketing income" does not change the classification; ITR-3 remains required.

  • Benefits of ITR-3: You can deduct all direct and indirect business expenses (hosting, ads, tools) from your gross earnings to calculate net taxable profit.

Affiliate income from NordVPN/Amazon Associates should first be examined based on the actual nature of the activity and the affiliate agreement. If the receipts are in substance commission/referral commission for introducing customers through affiliate links, they would generally constitute business income, but Section 44AD is specifically not available to persons earning commission or brokerage income. Therefore, ITR-4 should not be used for such income under 44AD merely because the activity is online.

ITR-3 would generally be applicable, with the income disclosed under PGBP and eligible business expenses claimed on actual basis.

Happy to help. For most ITR filing issues in AY 2026-27, the common troubleshooting steps are:

  1. Portal timeout / stuck: Clear browser cache and use the incognito mode on Chrome. The income tax portal performs best on Chrome in a fresh session.
  2. PAN-Aadhaar mismatch: If your return is getting rejected at validation, check PAN-Aadhaar linking status at incometax.gov.in > Our Services > PAN-Aadhaar Link. Unlinked PANs are now inoperative for filing.
  3. 26AS vs AIS mismatch: If you are showing income higher than AIS, file with the correct figure in your return and keep documentary evidence. A mismatch does not prevent filing - it may trigger a verification notice which you can respond to.
  4. Bank account validation: Pre-validate your bank account under My Profile before claiming refund. Refunds go only to validated accounts.

If the specific issue is different, share more details and I can give a more specific answer. This [ITR filing step-by-step guide for AY 2026-27](https://taxgarden.in/blog/itr-filing-login-guide-step-by-step-2026) also covers the portal navigation end to end.
