the private company can start its business after getting certificate of incorporation from ROC

As section 149 do not apply to a Private Limited company it can start it's business asap it gets Certificate of Incorporation.

A Private Limited Company can commence its business as and when it got CIN from ROC .In Companies Act, 1956 there is no provision for obtaining commencement of business for private company, but such provision will apply to public company to obtain certificate for commencement of business.

Pvt Company can start doing business once it get the certificate of incorporation from the respective ROC
