Guidance required in gst for transport service

Helllo All,

We are a startup planning to start Good transport Service(Providing Vehicle without labour for Materials transfers) to our few clients at market rates. Need to register GST to establish as a Service provider in Market. Kindly guide which HSN is cost saving.

Some refers to go under GTA with Reverse Charge mechanism.

Kindly guide us for GST Registration.

if service receiver is registered under gst then rcm is applicable but if unregistered then you have to collect gst @ 5%

rcm means Reverse charge mechanism ??

Most of the similar service providers and client is under GTA with Reverse Charge Mechanism under 996791 HSN

If I collects 5% do I need to pay any extra while paying tax or only actuals to be paid

 

 

As per Notification 5/2017 CT

GTA are exempt to obtain Registration in GST as their service fall under section 9(3)

As per Notification 13/2017 GTA services are under RCM , means recepient is liable to deposit GST.

Note : if the Recepient is URD then GTA services provided them are Exempted 

As per notification 22/2017
GTA can avail ITC on in his inward supply only if he charge 12% forward charges & recepient is also allowed to take ITC for on same

As per notification 11/2017 if GTA charge 5% then recepient is liable to do RCM & has to deposit  GST @ 5% , can take ITC for the same

If you do not registered As GTA , then as per notification 12/2017 Your services as Transporter is exempted

Which is advisable, Shall we register in GTA or Anyother HSN. 

Most of the other transporters are registered under GTA and they says they will claim Input tax for future asjustments.
